Terms and Conditions

1. About the service

Kinderbase is a kindergarten management platform offering, among other things: a news feed with photos and videos, attendance and daily reports, menus, invoicing, chat between the kindergarten and parents, notifications and child pick-up management. Available features may vary depending on the subscription chosen by the kindergarten.

2. Accounts and eligibility

Accounts are created based on an invitation from the kindergarten or by its administrators. You must be at least 18 years old to use the Platform.

You are responsible for keeping your login credentials confidential and for all activity carried out through your account. The information you provide when creating an account must be accurate and kept up to date. Notify us immediately at [email protected] if you suspect unauthorised access.

3. Using the Platform

When using the Platform, you agree not to:

• publish content that is unlawful, defamatory, obscene or that infringes the rights of others;
• harass, threaten or intimidate other users;
• download, capture or redistribute photos or videos of other children outside the Platform without their parents’ consent;
• access or attempt to access data not intended for you;
• disrupt the operation of the Platform, including through attacks, automated data extraction (scraping) or attempts to bypass security measures;
• use the Platform for purposes unrelated to the kindergarten’s activity.

We reserve the right to remove content and suspend accounts that violate these rules.

4. User content

The content you publish (photos, videos, messages, comments) belongs to you. By publishing it, you grant Kinderbase a non-exclusive, limited licence to host, store, process (for example, resizing and optimisation) and display that content within the Platform, solely for the purpose of providing the service.

The kindergarten is responsible for obtaining the consents required to publish photos and videos of children. If you notice content that violates these Terms or your rights, you can write to us at [email protected].

5. Subscriptions and payments

Kindergartens use the Platform under a subscription, according to the plans and prices published at kinderbase.ro/en/pricing or agreed by contract. Payments are processed through Stripe. Failure to pay the subscription may lead to suspension of access, after prior notice.

Invoices issued to parents through the Platform represent a direct relationship between the parent and the kindergarten; Kinderbase only facilitates their issuance and payment.

6. Availability and changes to the service

We make reasonable efforts to keep the Platform available at all times, but we cannot guarantee uninterrupted operation. There may be planned maintenance windows or outages caused by factors beyond our control.

We may modify, improve or withdraw features of the Platform. We will announce significant changes that affect its use in advance.

7. Intellectual property

The Platform, including its code, design, logos and the Kinderbase name, is owned by us or our licensors and is protected by intellectual property law. You may not copy, modify, decompile or create derivative works based on the Platform.

8. Data protection

The processing of personal data is described in the Privacy Policy, available at kinderbase.ro/en/privacy, which forms part of these Terms. For data entered by kindergartens, the processing relationship is governed by the data processing agreement concluded with each kindergarten.

9. Limitation of liability

The Platform is provided "as is". To the maximum extent permitted by law, Kinderbase is not liable for indirect damages (such as loss of profit or data) resulting from the use of, or inability to use, the Platform, and our total liability is limited to the amounts paid by the relevant kindergarten for the service in the previous 12 months.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, and nothing affects consumer rights under applicable legislation.

Kinderbase is not responsible for the accuracy of information entered by kindergartens or users (for example, menus, attendance, invoices).

10. Termination

The kindergarten may end its subscription in accordance with its contract. You can request the deletion of your account at any time from the app settings or at [email protected].

We may suspend or close accounts in case of breach of these Terms or abusive use of the Platform. When a contract ends, the kindergarten may export its data within a reasonable period, after which the data is deleted in accordance with the Privacy Policy.

11. Changes to the Terms

We may update these Terms from time to time. The current version is published on this page, and significant changes will be announced through the Platform before they take effect. Continuing to use the Platform after changes take effect constitutes acceptance of them.

12. Governing law and disputes

These Terms are governed by Romanian law. Disputes shall be resolved amicably, or otherwise by the competent courts of Romania. Consumers may also contact the Romanian National Authority for Consumer Protection (ANPC) or use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
